1. WHO WE ARE & WHAT THIS IS
Welcome to Magma Math’s Privacy Policy. Magma Math, also called Matteappen in certain geographic regions, is a service (the “Service”) developed by Radish Education, Inc. a Delaware corporation (the “Company”) and its affiliates, for teaching and learning mathematics and science. The application supplies users with a platform for solving problems, and for supporting the interaction between students and teachers in an education setting. This Privacy Policy describes our practices in connection with data we collect through applications and websites operated by us (collectively, the “Site”).
Magma Math respects your privacy and is committed to protecting your personal information. This privacy policy will inform you as to how we look after your personal information when you use our services and tell you about your privacy rights and how the law protects you.
This Privacy Policy may be updated from time to time. We will notify you of any material changes by contacting you at the email address you have provided us and by posting the new Privacy Policy on the Site. You are advised to consult this policy regularly for any changes. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use. As used in this policy, the terms "using" and "processing" information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to, collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our organization or among our affiliates within the United States or internationally.
2. THE CHILDREN'S ONLINE PRIVACY PROTECTION ACT OF 1998
We comply with The Children's Online Privacy Protection Act of 1998 (COPPA). COPPA and its rules require us to inform parents and legal guardians (“Parents”) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“Children”). It also requires us to obtain verifiable consent from a child's Parent, or to confirm that the child’s teacher has obtained verifiable consent from such child’s Parent, for certain collection, use, and disclosure of the child's personal information.
Read more about COPPA at the FTC's COPPA page. This regulation is designed to protect the privacy of your children. In order for a child under the age of 13 to use Magma Math’s services, their teacher must approve the registration.
3. THE FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACT
This Privacy Policy and our Service are designed to meet our responsibilities to protect personal information from the students' educational records under the Family Educational Rights and Privacy Act (“FERPA”). We agree to work with each Teacher and their affiliated school or district to jointly ensure compliance with the FERPA regulations.
4. INFORMATION WE COLLECT
The information we learn from teachers and from children (as students) helps us not only provide the Service but also to personalize and continually improve each user’s experience with the Service. Certain tailored content and features are available only to registered users, and require us to collect certain information, including personal information, from them so we can determine what tailored content and features to make available to them. In addition, we use certain technologies, such as cookies, to automatically collect information from our users (including children) when they visit or use the Site.
We only collect as much information about a child as is reasonably necessary for the child to participate in an activity, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary.
Here are the types of information we gather:
i. Information You Give Us Directly
Teacher Information: When you create an account as a teacher with Magma Math, we ask you for personally identifiable information such as your name, email address, school name, username, and password, which we will use to contact or identify you (your “Teacher Profile Information”). We may also ask for information to verify your credentials and your affiliation with a particular school or district.
Student Information, Including Information we Collect from Children under 13: Students, including children, must provide us with a first name, last name, username, and password to create and verify an account. Students may provide this information to us directly or their Teacher may provide it to us where appropriate. Student profile information will be available to the teacher who is associated with the student. A student’s enrollment at a school may be derived from Teacher Profile Information. A student’s name and username are available to the other students in any class the student has joined, and may also be available to other Teachers or administrators with registered accounts within the same school.
User-generated Content: In addition to the profile information requested at time of registration, teachers and students, including children, can create or edit other types of content such as math problems and solutions (“Content”). Content is viewable only by those users the teacher expressly authorizes to view it. By default, Content is not publicly viewable unless a Teacher expressly opts in to making the Content viewable to other users of the Service. If a Teacher opts to make Content available to users outside their classroom or school, any such Content will be anonymized and de-identified such that it cannot be linked to an individual.
ii. Automatic Information Collected
Like many other websites, we also collect information through cookies and other automated means. Information of this sort includes:
Technical information about a user’s browser and mobile device: This information is used in the aggregate to help us optimize the Service for common browsers and devices.
Usage information, such as the Content and features that users interact with: We collect and use this behavioral information and may use it in anonymized and aggregate forms to generate statistics about users and how the Services are being used but the information is not shared in any form that could be used to identify users personally. Please see “How we use and share the information we collect,” below, for further information and choices about sharing information with third parties.
IP address and log file information, web beacons, cookies, tokens and device identifiers: These are alphanumeric identifiers that help us to distinguish between unique browsers and devices in order to avoid showing users the same information twice, keep users logged into Magma Math, prevent duplicate actions and improve your experience. The information we collect from cookies may include IP address, browser and device characteristics, referring URLs, and a record of interactions with our Service. By using the Service, you are consenting to such use of cookies. Most Web browsers can be set to inform users when a cookie has been placed and provide users with the opportunity to refuse that cookie. We will respect your choices relating to on-line tracking, whether you choose to reject individual cookies or set your web browser to reject cookies and other tracking technology. However, refusing a cookie may, in some cases, preclude you from using, or negatively impact the display or function of, the Service or certain areas or features of the Service.
Crashes and error reports: If you encounter a crash or error while using our Service, we may generate a crash report that includes technical, usage and, if you are logged in, your account information so that we can diagnose and potentially prevent the problem in the future.
iii. Lawful Basis to Information Processing
We process your personal data only when we have a lawful basis. Presently, we have a legitimate interest and, in some cases, your consent as the lawful basis for
processing. Our legitimate interest is to deliver the Service to you. We have determined that our processing of your personal data is necessary to deliver the Service to you, and that there is no less intrusive means of delivering you the Service. Finally, we believe that our processing of personal data will not cause unjustified harm in a way that would override our legitimate interest basis. In some cases, we may use consent as our lawful basis for collecting and processing certain types of personal information. In such cases, you have a right to withdraw the consent at any time. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.
5. HOW WE USE AND SHARE THE INFORMATION WE COLLECT, INCLUDING INFORMATION ABOUT CHILDREN
We use the information we collect for things like:
• Establishing and managing a user’s account and providing the Service • Conducting research and analysis, such as estimating our audience size and usage patterns
• Storing information about each user’s preferences, allowing us to customize the content according to individual interest where appropriate
• Identifying users on the Service and communicating things like surveys and offers that may be of interest
• Operating, evaluating and improving our business
We will not share, sell, rent or transfer any user’s personal or account information with third parties other than as described here.
We do not allow advertising companies to collect data through our service for ad targeting, nor do we collect, use or sell your information on behalf of or for advertising companies.
We may disclose aggregated usage and demographic information collected from our users but not in a way that can identify a user individually.
We may disclose personal information:
• To third parties we use to support the internal operations of our Service and who are bound by contractual or other obligations to use the information only for such purposes and to keep the information confidential.
• If we are required to do so by law or legal process, such as to comply with a regulation, court order or subpoena.
• If believe disclosure is necessary or appropriate to protect the rights, property or safety of or prevent harm or loss to Magma Math, our customers, or others, including to protect the safety of a child, to protect the safety or security of the
Service, to enable us to take precautions against liability, or in connection with an investigation of suspected or actual unlawful activity.
We may also share your personal information in the event of a corporate sale, merger, acquisition, dissolution or similar event.
6. HOW WE STORE AND PROTECT THE INFORMATION WE COLLECT
Magma Math uses reasonable security measures to store and protect the information under our control and appropriately limit access to it. However, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.
We want you to feel confident using the Services. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personally identifiable information, usage data or other communications will always remain secure. We will notify you by email if we have reason to believe that your personal information has been compromised due to a security breach or used in an unauthorized manner, but by using this Service, in accordance with the Terms of Use you agree to release us from any and all claims arising out of unauthorized use of your information.
7. YOUR CHOICES REGARDING THE INFORMATION WE COLLECT
You may choose to:
• View, update and correct your account and personal information • Stop receiving marketing or promotional e-mails, direct mail, or other marketing communications
• Cancel your account or request that we no longer use your child’s information to provide services
• Request removal of your or your child’s personal information or Content from our Service
Data Retention
We will only retain a user’s profile information and Content for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. In some circumstances we will anonymize your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you. Outside of these situations, if you terminate your account, we will delete your account, including your first name, last name, username, and password, within thirty (30) days of receiving your termination request.
We will make reasonable efforts to enable you to delete your Content and profile information from our database upon request, which may be done by contacting us at legal@magmamath.com.
8. ADDITIONAL INFORMATION
Using the Services from outside the United States
This Privacy Policy is intended to cover collection of information from residents of the United States. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. Please be assured that we seek to take reasonable steps to ensure that your privacy is protected. By using the Service, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Privacy Policy.
